Acceptance

These Terms of Service (“Terms”) govern your use of the websites operated by Future Industries (“we,” “us,” “our”), including deconversion.net, futureindustries.com, and any other Future Industries marketing site that links to these Terms. By accessing or using any of these websites, you agree to these Terms. If you do not agree, do not use the sites.

These Terms do not govern any system Future Industries builds or operates for a client; that work is governed by the applicable Master Services Agreement.

What we do

These websites are marketing surfaces for Future Industries, a United States operational technology consulting firm. The content describes our services, methodology, pricing structure, and engagement options. The websites are informational; they are not an offer of services, an offer to sell or buy securities, or an offer of investment advice.

Eligibility and use

You may use these websites only for lawful purposes and in accordance with these Terms. You agree not to:

  • use the sites to violate any applicable law or regulation;
  • attempt to gain unauthorized access to any part of the sites or our systems;
  • interfere with the operation of the sites, including by submitting malicious code, denial-of-service traffic, or automated scraping that imposes an unreasonable load;
  • use any text, image, or other content from the sites for purposes that would mislead a reasonable reader as to the source, sponsorship, or endorsement of the content;
  • impersonate another person or misrepresent your affiliation when contacting us through the sites.

You must be at least sixteen (16) years old to submit personal information through any form on the sites.

All content on these websites, including text, graphics, logos, and the underlying software, is owned by Future Industries or licensed to us, and is protected by United States and international intellectual-property laws. You may view and download content from the sites for your own internal business or personal reference. References to third-party trademarks (Salesforce, SAP, ServiceNow, Oracle, HubSpot, Workday, Microsoft, and others) are made for descriptive purposes only and remain the property of their respective owners. Future Industries is not affiliated with, endorsed by, or sponsored by any of these companies.

Forms and information you submit

When you submit information through a contact form, assessment form, or email-gate on these sites, you represent that the information you submit is accurate to the best of your knowledge and that you are authorized to submit it. We use information you submit as described in our Privacy Policy.

Forward-looking and illustrative content

These websites describe our services and the engagement scopes under which we deliver them. Where we present numeric reference figures (engagement hours, calendar duration, projected savings, exit-multiple impact, and similar), those figures are modeled or illustrative unless we specifically describe them as historical client outcomes. Modeled figures are derived from public benchmarks and our own engineering assumptions; they are not predictions of any specific outcome for any specific client. Actual outcomes depend on the specific scope, contracts, integrations, and decisions of the engagement.

Nothing on these websites is investment advice, legal advice, tax advice, or a securities offering. Future Industries is not registered as an investment adviser or broker-dealer.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FUTURE INDUSTRIES, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE WEBSITES OR ANY CONTENT ON THEM, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by applicable law.

Indemnification

You agree to defend, indemnify, and hold harmless Future Industries and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (i) your use of the websites, (ii) your violation of these Terms, or (iii) your violation of any law or the rights of any third party.

Governing law and disputes

These Terms are governed by the laws of the State of [governing law pending], United States, without regard to its conflict-of-laws rules. Any dispute arising out of or related to these Terms or the websites will be resolved exclusively in the state or federal courts located in [governing-law county and state pending], and you consent to the personal jurisdiction of those courts. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force. These Terms (together with the Privacy Policy and any other notices we post) are the entire agreement between you and Future Industries regarding the websites.
